Actor Jamie Foxx is accused of sexual assault in a recent New York lawsuit
American actor Jamie Foxx is getting sued by a woman who alleges in a new lawsuit that he sexually assaulted her at a New York City restaurant eight years ago. A lawsuit has been filed against this Oscar-winning actor on Wednesday that accuses Jamie of groping a woman wrongfully at a Manhattan restaurant in August 2015. The plaintiff is identified in the complaint only as Jane Doe said that the sexual assault happened in a rooftop lounge she along with a friend approached the actor and took pictures with him.
According to the lawsuit it was after they had their picture taken that Foxx groped the unnamed woman. Foxx, whose real name is Eric Marlon Bishop is being sued for damages, alleging “sexual assault, abuse, assault and battery”. Representatives of Foxx did not immediately respond to the lawsuit or to requests for comment on the lawsuit that seeks unspecified damages.
The lawsuit alleges that the assault happened at around 01:00 p.m. on 26 August 2015 at Catch NYC, a rooftop lounge where the woman was seated beside the actor. The plaintiff said that Foxx appeared to be intoxicated and when asked for a picture, he agreed saying, “sure, baby, anything for you”. It also added that Jamie told the woman that she had a body like a supermodel and smelled. According to the lawsuit, Jamie engaged in groping the woman and putting his hands under her clothes without her consent or will. The incident was interrupted by her friend finding the two of them together and Jane Doe left the scene.
The lawsuit says that the actor led her to a secluded part of the restaurant and then proceeded to touch her breasts and put his hands in her underwear against her will which ended when her friend came looking for her. The plaintiff is also seeking damages from Mark Birnbaum, the restaurant and bar owner who according to the accuser was seated with Mr Fox before the alleged sexual assault happened. Mr. Birnbaum also did not make any statement on the lawsuit.
This New York lawsuit also added that these “heinous acts” made a great impact on the accuser and she “suffered and continues to suffer severe emotional distress and anxiety, humiliation, embarrassment, post-traumatic stress disorder, and other physical and emotional damages”.
The actor is an Academy Award nominee for his portrayal in the film Collateral in 2004 and in that same year, he also gave his career-best performance yet as the singer Ray Charles in the film Ray which got him his Oscar. He is one of the artists being accused of sexual assault which makes his case one of the most high-profile cases in recent times. Under the Adult Survivors Act, which is a New York state law that allows lawsuits to be filed in court even if the statutes of limitations have run out, several accusations are coming to light and Jamie is a recent addition to that. This ends on November 24th and lawsuits have already been filed against former president Donald Trump, comedian Bill Cosby, rapper V, etc.
